FCA DPC — FSMA 2023 Sch.9

Deferred Payment Credit regulation effective 15 Jul 2026. Removes BNPL/DPC exemption from regulated consumer credit. Triggers FCA CONC 4, 5, 6, 7 obligations. Consumer Duty applies to all DPC products from authorisation. FSMA 2023 Schedule 9 scope criteria.

FG21/1 — Vulnerable Customers

FCA Guidance FG21/1 (effective Feb 2021) on firms' treatment of vulnerable customers. Applies alongside Consumer Duty. Four vulnerability drivers: health, life events, resilience, capability. Requires tailored communications, escalation processes, and MI monitoring. Reinforced by PS22/9 §5–8.

PRIN 2A — Consumer Duty Rules

CONC — Consumer Credit Sourcebook

FCA CONC applies to consumer credit and DPC products. CONC 4 (financial promotions), CONC 5 (creditworthiness / affordability), CONC 6 (adequate explanations), CONC 7 (arrears / forbearance). Overlaps Consumer Duty for credit products including BNPL/DPC.

SUP 15.3 / SYSC 4

SUP 15.3 requires Material Events notification to FCA. SYSC 4 Senior Management Arrangements impose board responsibility for Consumer Duty oversight. Board must receive annual Consumer Duty report (PS22/9 §12.4) and MI must be designed to enable oversight (SYSC 4.1.1R).
